Le intercettazioni e i criptofonini

Abstract

L' elaborato tratta nella prima parte le principali caratteristiche delle intercettazioni, analizzando nello specifico i presupposti di applicazione delle intercettazioni telefoniche, ambientali, tramite captatore informatico ed infine l'ipotesi particolare delle intercettazioni per i reati di criminalità organizzata. Successivamente si esamina l'utilizzazione degli esiti captativi in altri procedimenti, il procedimento esecutivo e il rapporto tra intercettazioni e informazione. Infine, ci si sofferma sull'impiego dei criptofonini, analizzandoli dal punto di vista tecnico e giuridico. E' sembrato Interessante illustrare il caso Sky ECC/Encrochat e i metodi che le squadre investigative straniere hanno elaborato per ottenere importanti risultati probatori, la cui circolazione ha richiesto l'impiego di strumenti di cooperazione giudiziaria.

This paper initially delves into the key characteristics of interceptions, with a specific focus on the prerequisites for telephone, environmental, and computer-based interceptions. It also examines the particular case of interceptions for organized crime offenses. Subsequently, the paper explores the use of intercepted evidence in other proceedings, the execution process, and the relationship between interceptions and information. Lastly, it focuses on the use of cryptophones, analyzing them from a technical and legal standpoint. A particularly interesting case study is that of Sky ECC/Encrochat, illustrating the methods employed by foreign investigative teams to obtain significant evidentiary results. The circulation of this evidence required the use of judicial cooperation tools.
