Il percorso di cura dei pazienti psichiatrici sottoposti a misure di sicurezza: una ricerca sul territorio genovese

Abstract

La scelta di approfondire il percorso di cura dei pazienti psichiatrici sottoposti a misure di sicurezza è motivata da un interesse personale nato durante il tirocinio presso il Centro di Salute Mentale che ha suscitato il desiderio di esplorare le dinamiche e le criticità del settore, rendendo l'argomento rilevante nel contesto attuale con l'avvio delle Residenze per l’Esecuzione delle Misure di Sicurezza (REMS) che ha evidenziato lacune nel sistema, con pazienti in attesa e difficoltà nella gestione e riabilitazione di quelli autori di reato

La tesi si articola in tre capitoli: il primo tratta l'evoluzione del trattamento psichiatrico in Italia, dalle origini dei manicomi alle REMS, per comprendere le radici delle attuali problematiche e le riforme legislative; il secondo esamina gli strumenti giuridici di difesa sociale dalla malattia psichiatrica, analizzando il sistema del doppio binario, l'imputabilità, la pericolosità sociale e le novità legislative, con una discussione sul concetto di recovery; il terzo è una ricerca sul campo presso strutture psichiatriche attraverso interviste a psichiatri e un assistente sociale, esaminando interventi, pratiche di cura, l'efficacia dei trattamenti e le percezioni dei professionisti sul processo di recovery e il suo impatto sulla vita dei pazienti L'obiettivo è confrontare il processo legislativo con la realtà vissuta dagli operatori e le loro percezioni.

The decision to delve into the care pathway of psychiatric patients subject to security measures is driven by a personal interest that developed during an internship at the Mental Health Center, which sparked a desire to explore the dynamics and critical issues of this sector, making the topic relevant in the current context with the introduction of the Residences for the Execution of Security Measures (REMS). This transition has highlighted gaps in the system, with patients waiting for access and existing difficulties in managing and rehabilitating psychiatric patients who have committed crimes.

The thesis is structured into three chapters: the first covers the evolution of psychiatric treatment in Italy, from the origins of asylums to the REMS, to understand the roots of current issues and the legislative reforms implemented; the second examines the legal tools of social defense against psychiatric illness, analyzing the double-track system, criminal responsibility, social dangerousness, and legislative innovations, with a discussion on the concept of recovery; the third is field research conducted at psychiatric facilities through interviews with psychiatrists and a social worker, examining the types of interventions carried out, care practices, the effectiveness of treatments, and the perceptions of professionals regarding the recovery process and its impact on patients' social lives. The objective is to compare the legislative process with the reality experienced by practitioners and their perceptions.
