La giurisprudenza della Corte europea sull'art.3 Cedu

Abstract

Questo elaborato ha l'obiettivo di analizzare l'evoluzione della giurisprudenza della Corte di Strasburgo per quanto riguarda l'evoluzione dei concetti tutelati dall'art.3 Cedu. Allo stesso tempo, questa dissertazione ha lo scopo di analizzare i riflessi delle pronunce della Corte EDU nell'ordinamento italiano, evidenziando pregi e difetti della normativa adottata dal legislatore italiano in seguito alle pronunce della Corte sovranazionale.

The aim of this paper is to analyse the evolution of the jurisprudence of the Court of Strasbourg with regard to the evolution of the concepts protected by Article 3 of the ECHR. At the same time, this dissertation aims to analyze the repercussions of the judgments of the ECtHR in the Italian legal system, highlighting the strengths and weaknesses of the legislation adopted by the Italian legislator following the rulings of the supranational Court.
