Libertà di manifestazione del pensiero vs. Libertà religiosa nell'ordinamento canadese: un "dissidio" da ricomporre.

La presente ricerca vuole analizzare la disciplina del conflitto tra libertà di espressione e libertà religiosa nell'ordinamento canadese. Partendo da una breve rassegna delle fondamentali tappe storiche che hanno condotto all'adozione del Constitution Act del 1982 e operate alcune riflessioni sul valore assegnato alla libertà di espressione e alla libertà religiosa in astratto, verranno esaminati alcuni casi concreti, con l'obiettivo di fornire una panoramica generale sulla linea evolutiva della giurisprudenza della Corte Suprema. Successivamente, l'attenzione verrà posta su due importanti ambiti in cui il conflitto fra religione ed espressione può dispiegarsi. Il primo riguarda la blasfemia: dopo una breve analisi storica delle influenze britanniche sulla disciplina canadese verranno riportati i casi in cui la normativa repressiva abbia avuto rilevanza all'interno di un processo per poi volgere lo sguardo ai recenti sviluppi orientati all'abrogazione. Il secondo riguarda la disciplina dei discorsi d'odio: dopo una breve analisi sui possibili modelli di disciplina in ottica comparatistica, verranno esaminati alcuni casi canadesi in cui il fattore religioso ha avuto particolare rilievo, sia come fonte sia come bersaglio dell'odio, con particolare attenzione agli ambiti di maggiore interesse nella società contemporanea. This research aims to analyze the regulation of the conflict between freedom of expression and religious freedom in the Canadian legal system. Starting with a brief review of the fundamental historical milestones that led to the adoption of the Constitution Act of 1982 and making some reflections on the value assigned to freedom of expression and religious freedom in the abstract, a number of concrete cases will be examined, with the aim of providing a general overview of the evolving line of Supreme Court jurisprudence. Next, attention will be paid to two important areas in which the conflict between religion and expression can unfold. The first concerns blasphemy: after a brief historical analysis of British influences on Canadian discipline, cases in which repressive legislation has had relevance within a trial will be reported and then look to recent developments geared toward repeal. The second is concerned with the discipline of hate speech: after a brief analysis of possible models of discipline from a comparative perspective, a number of Canadian cases will be examined in which the religious factor has been particularly prominent, both as a source and as a target of hate, with a focus on the areas of greatest interest in contemporary society.
