I principi di correttezza professionale

Abstract

Lo studio si è posto il problema dell'analisi di come possano essere interpretati i principi di correttezza professionale all'interno dell'art. 2598 n.3 c.c. In particolare si è soffermato sulle due grandi teorie interpretative ad essi relative: le tesi etero-integrative e le tesi auto-integrative. Nelle analisi di queste tesi l'elaborato si è soffermato su ciò che affermano dottrina e giurisprudenza a partire dai primi anni di vigenza del codice fino ad arrivare agli indirizzi più recenti.

The study has faced the problem of analyzing how the principles of professional correctness within the article 2598 n.3 c.c. can be interpreted. In particular it focused on the two great interpretative theories relating to them: the hetero-integrative theses and the self-integrative theses. In the analyzes of these theses, the paper focused on what doctrine and jurisprudence affirm starting from the first years of the code's validity up to the most recent trends.
