Il diritto alla salute alla prova della pandemia da Covid-19: una prospettiva di diritto comparato.

In questo elaborato, si propone una riflessione sulla tutela del diritto alla salute e sulle conseguenze che il CoVID-19 ha avuto su di esso. Dapprima viene descritto il significato giuridico assunto dal concetto di salute nel diritto internazionale e in alcuni specifici ordinamenti - più nello specifico USA, Germania, Francia, Regno Unito e, infine, Italia. Si vede poi successivamente come questo si concretizza nell’adozione del sistema sanitario più adeguato alla realtà statale di riferimento, evidenziando le disuguaglianze che ogni modello comporta. Dopo una sommaria esposizione della procedura di gestione globale delle emergenze sanitarie prevista dal Regolamento sanitario interazionale (2005), ci si dedica agli effetti che le misure emergenziali nazionali hanno avuto sui diritti fondamentali. Si sottolinea, quindi, che, nel bilanciamento tra la necessità di assicurare una protezione dal rischio di contagio e la garanzia delle diverse libertà dell’uomo, queste ultime sono state in alcuni momenti compresse. In particolare, il diritto alla salute, visto come diritto a ricevere un’equa assistenza medica, è stato accantonato e ha spesso lasciato spazio alle esigenze della crisi sanitaria. Nel complesso, si può ritenere quindi che il virus abbia inasprito quelle che erano le disparità - sociali, economiche e sanitarie - già esistenti. In this paper, we propose a consideration on the right to health and the conseguencies that CoVID-19 had on it. Initially, we describe the juridical meaning that the right to health acquires in the international law and in some legal systems - specifically in the USA, in Germany, in France, in the United Kingdom and, at last, in Italy. Later, we explain how this meaning has been actualized through the adoption of the most appropiate healthcare system for the national order emphasizing their inequalities. After a brief exposition of the procedure for the global governance of the health emergencies set by the International health regulations (2005), we dedicate to the effects of the national emergency measures on the fundamental rights. In fact, we underline that, during the balance between the need of assure a protection against the risk of infection and the guarantee of the many human freedom, theese last ones have been sometimes compressed. In particular, the right to healt, understood as the right to receive a fair medical assistance, has been put aside and it has given way to the need of the health crisis. Overall, we can consider that the virus has increased the social, economic and health inequalities that already exist.
