L’obiettivo del mio lavoro è quello di evidenziare l’importanza del principio di effettività e pienezza della tutela all’interno della giustizia amministrativa, in quanto risponde a una necessità insopprimibile sia per tutelare l’interesse del cittadino leso sia per garantire il corretto svolgimento del processo attraverso gli strumenti normativi a disposizione.
L’importanza di tale principio è stata confermata nel diritto positivo con l’emanazione del Codice del processo amministrativo, avvenuta con il D. Lgs. 104/2010 ed entrato in vigore il 16 settembre 2010, dopo una serie di tentativi di codificazione che, come spiegherò in seguito, vennero avviati già a partire dagli anni ‘70.
Dopo un breve excursus su temi come i diritti soggettivi e le varie tappe evolutive del sistema amministrativo, ho posto la mia attenzione sulla natura di processo amministrativo, in particolare sulle ragioni che ne hanno determinato il mutamento da un processo basato sull’atto a uno basato sul rapporto.
Attraverso l’analisi del principio di effettività, ho esaminato, inoltre, le varie azioni esperibili nel processo amministrativo e le conseguenze che ne derivano in materia cautelare, senza trascurare il rilievo che tale principio ha assunto in ambito europeo anche grazie all’operato della Corte di Giustizia. The objective of my work is to highlight the importance of the principle of effectiveness and fullness of protection within administrative justice, as it responds to an irrepressible need both to protect the interest of the offended citizen and to guarantee the correct execution of the process through the regulatory tools available.
The importance of this principle was confirmed in positive law with the enactment of the Code of administrative process, which took place with Legislative Decree 104/2010 and entered into force on 16 September 2010, after a series of attempts at codification which, as I will explain later, started as early as the 1970s.
The codification of the principle of effectiveness therefore represents the conclusion of a long and important process of refinement of those instruments necessary and useful for guaranteeing full and effective protection of the private.
After a brief excursus on topics, such as individual rights and the various evolutionary stages of the administrative system, I focused my attention on the nature of the administrative process, in particular on the reasons that led to the change from a process based on the act to one based on report.
Through the analysis of the principle of effectiveness, I also examined the various actions that can be taken in the administrative process and the consequences that derive from them in precautionary matters, without neglecting the importance that this principle has assumed in the European context also thanks to the work of the Court of Justice.
