Lo stato di guerra e lo stato di emergenza: garanzie costituzionali e problematiche ordinamentali

Abstract

L’elaborato vuole concentrarsi sugli strumenti e sui problemi che scaturiscano in caso di emergenza. Lo studio si sofferma, oltre che sullo stato di emergenza in senso stretto, sul ruolo del Governo, del Parlamento, del Consiglio Supremo di Difesa e sul ruolo del Presidente della Repubblica italiana. Oltre alle ipotesi di potenziale emergenza, l'attenzione è orientata all'attuale crisi russo-ucraina e alle condizioni e ai limiti caratterizzanti le missioni militari italiane all'estero. Il centro nevralgico dello studio è il fenomeno dell'invio di materiale bellico in Ucraina da parte dell'Italia. La posizione dell'Italia e le modalità con cui essa ha operato ed opera, hanno provocato una spaccatura, profonda, delicata e non risolta, in dottrina, in giurisprudenza e anche tra l'opinione pubblica. Tuttavia, nell’orientamento prevalente tale posizione appare in linea con il principio internazionalista e con il principio pacifista di cui agli artt. 10 e 11 Cost.

The thesis focuses on the tools and problems during an emergency situation. The study focuses, in addition to the state of emergency in the strict sense, on the role of the Government, Parliament, Supreme Defense Council and role of the President of Italian Republic. Specifically, it focuses on conditions concerning the pacifist principle and methods through which the declaration of a state of war takes place. In addition to hypotheses of potential emergencies, the attention in the thesis is for the current Russian-Ukrainian crisis and for the conditions and limits of Italian military missions abroad. The nerve center of the study is the phenomenon of sending war material to Ukraine by Italy. Italy's position and the ways in which it operates, has caused a rift now, deep, delicate and not resolved, in doctrine, in jurisprudence and also between public opinion.
