Lo scopo di questo lavoro è indagare i limiti e gli eccessi della libertà d’espressione. Al giorno d’oggi capita frequentemente di sentire la frase “non si può più dire niente”. Si è tentato di verificare la fondatezza di tale enunciato ponendosi come domanda “cosa può giustificare la libertà d’espressione?”, nei confronti soprattutto di hate speech e fake news. Si è analizzato il contesto giuridico dell’Europa e degli Stati Uniti, considerando i testi giuridici e le sentenze, anche osservando come cambia l’importanza attribuita ai diritti e alle libertà fondamentali. Si è posto poi l’ecosistema di Internet come punto di confronto, poiché la rivoluzione digitale ha comportato una significativa mutazione antropologica. Parallelamente abbiamo ripercorso le principali teorie dei pensatori che hanno influenzato la positivizzazione e la difesa della libertà d’espressione, come Spinoza, Milton, Locke e Mill.
In seguito abbiamo analizzato il politically correct, la cancel culture e il more speech, facendo chiarezza su ciascuno di questi fenomeni sociali. Considerando l’importanza del linguaggio, si concluderà, con le dovute argomentazioni, con l’augurio di mantenere gli aspetti positivi delle sopra citate iniziative, volte a sensibilizzare il tema delle discriminazioni delle minoranze. The purpose of this work is to investigate the restrictions and the abuses of free speech. Nowadays we frequently hear the phrase "nothing can be said anymore". An attempt was made to verify the legitimacy of this statement by asking the question "what can justify freedom of expression?", especially with regard to hate speech and fake news. We have analyzed the legal system of Europe and the United States, considering legal texts and sentences, also observing how the importance attributed to fundamental rights and freedoms changes. The Internet ecosystem was then placed as a point of comparison, since the digital revolution has led to a significant anthropological mutation. At the same time, we retraced the main theories of the authors who influenced the positivization and the defense of free speech, such as Spinoza, Milton, Locke and Mill.
Then, we have analyzed “political correctness”, “cancel culture” and “more speech”, clarifying each of these social phenomena. Considering the importance of language, we will conclude, with the necessary arguments, with the hope of maintaining the positive aspects of the aforementioned initiatives, aimed at raising awareness of the issue of discrimination against minorities.
