Questo elaborato offre un’analisi dello sviluppo dell’istituto giuridico del mutuo all’interno del diritto romano. Infatti, esso ha visto la sua nascita già nei primi anni di crescita di questa società: i cives necessitavano di questo strumento per poter soddisfare esigenze di vita quotidiana. L’impero romano, poi, si è espanso sempre di più, entrando in contatto con nuovi popoli e tradizioni, pertanto, il contratto in questione si è sviluppato al fine di soddisfare le nuove esigenze di credito dei cittadini che vivevano in un mondo in cui i commerci e le finanze erano sempre più evoluti.
Ed è proprio in questo periodo che i giuristi hanno iniziato ad occuparsi del contratto di mutuo; prima, infatti, agli arbori della civiltà, non era previsto alcun tipo di regolamentazione giuridica per questo istituto, che era governato dalle sole norme sociali.
Quando, poi, i giuristi hanno focalizzato la loro attenzione sul mutuo, hanno, in primis, evidenziato quali requisiti dovevano esser soddisfatti affinché le parti potessero concludere validamente un contratto di questo tipo e, in secondo luogo, hanno elaborato una tutela processuale volta, specialmente, a proteggere il mutuante in caso di mancato adempimento da parte del mutuatario.
Inoltre, nel tempo, il contratto di mutuo è entrato in contatto con altri istituti del diritto romano, quali, esempio, il deposito e la stipulazione. In merito a quest’ultima, i cittadini romani avevano iniziato ad inserire all’interno del mutuo una stipulatio, al fine di eludere il regime di gratuità cui esso sottostava.
Queste, in linea di massima, rappresentano le tematiche che verranno affrontate all’interno della ricerca, volta a descrivere il processo di nascita e sviluppo del contratto di mutuo nel diritto romano, che ha ideato un istituto la cui funzione è fondamentale ancora oggi. This paper offers an analysis of the development of the legal institution of the loan contract within Roman law. In fact, it saw its birth in the early years of the growth of this society: the cives needed this instrument in order to satisfy everyday needs. The Roman empire, then, expanded more and more, coming into contact with new peoples and traditions, therefore, the contract in question developed in order to meet the new credit needs of citizens who lived in a world where trade and finances were increasingly evolving.
And it was precisely at this time that jurists began to deal with the loan contract; before, in fact, at the dawn of civilisation, there was no legal regulation of this institution, which was governed solely by social norms.
Then, when jurists focused their attention on the loan, they first pointed out what requirements had to be met in order for the parties to validly conclude such a contract, and secondly, they elaborated a procedural protection aimed, in particular, at protecting the lender in the event of non-performance by the borrower.
Moreover, over time, the loan contract came into contact with other institutions of Roman law, such as, for instance, the deposit and stipulation. With regard to the latter, Roman citizens had begun to include a stipulatio within the loan in order to circumvent the gratuitousness regime to which it was subject.
These, in principle, represent the issues that will be addressed within the research, aimed at describing the process of birth and development of the loan contract in Roman law, which devised an institution whose function is still fundamental today.
