Dall'hate speech al politicamente corretto. Divergenze e affinità tra società e diritto.

Abstract

L'elaborato tratta in tema di libertà di espressione il ruolo del politicamente corretto nella società. Viene innanzitutto considerato come il diritto regola tale libertà in Italia, in Europa e negli Stati Uniti, questi ultimi culla del politicamente corretto. Per poter comprendere il contesto in cui nasce è importante anche l'analisi della sicietà dove si sviluppa, ovvero una società multiculturale in cui si verificano spesso divergenze nel modo di pensare e di vivere e che porta a discriminazioni. Diventa quindi spesso necessario l'intervento del diritto per regolare i contrasti tra gli individui. Perciò si osserverà il ruolo del diritto nella società e come il politicamente corretto influisca sulla libertà di esprimere il proprio pensiero. Si analizzerano i pro e i contro del politicamente corretto per comprendere se esso possa essere d'aiuto alla costruzione di una società più giusta ed equa e in quale modo e quantità l'intervento del diritto sia necessario per regolamentarlo.

The thesis deals with the role of the politically correct in society in terms of freedom of expression. It is first of all considered as the law regulates this freedom in Italy, in Europe and in the United States, the cradle of politically correct. In order to understand the context where it was born, it is also important to analyze the society in which it develops, that is a multicultural society where divergences often occur in the way of thinking and living and which leads to discrimination. The intervention of law is often necessary to regulate the conflicts between individuals. Therefore we will observe the role of law in society and how politically correct affects the freedom to express one's thoughts. The pros and cons of politically correct will be analyzed to understand if it can help to build a more just and equitable society and in what manner and quantity the intervention of law is necessary to regulate it.
