Gli Stati Uniti e le Organizzazioni Internazionali: leadership, influenza e atteggiamento.

Abstract

Obiettivo primario della tesi è analizzare il ruolo degli Stati Uniti all'interno delle Organizzazioni internazionali, al fine di comprendere se l'influenza e la posizione di leadership degli Stati Uniti hanno una base giuridica sui trattati e sugli accordi che li istituiscono. L’attenzione è focalizzata su due tra le più importanti organizzazioni internazionali, le Nazioni Unite e l'Organizzazione mondiale del commercio. Il punto di partenza è lo studio del rispettivo quadro giuridico e dei trattati e degli accordi che li disciplinano. L’elaborato ha altresì lo scopo di indagare il rapporto degli Stati Uniti con un importante attore globale e organizzazione internazionale, l'Unione Europea. Viene quindi presentata una panoramica generale delle relazioni transatlantiche, illustrando le istituzioni formali su cui si basa la cooperazione UE-USA. Infine, l’analisi si focalizza sullo stato attuale delle relazioni nei vari settori chiave: commercio, sicurezza e difesa, promozione della democrazia, cambiamento climatico e salute.

The main objective of the dissertation is to analyze the role of the United States within the International Organizations in order to understand if US influence and leadership position have a legal basis on the treaties and agreements establishing them. The focus is on two major international organizations, the United Nations and the World Trade Organization. The starting point from which to proceed to investigate US attitude towards IOs is the study of their legal frameworks and the law and agreements governing them. The first chapter is dedicated to the United Nations. After a brief historical note on the creation of the UN, discussion focuses on the right to veto and the power that results from it, on the membership procedure and US influence in it, on US contribution to the UN budget and its impact on UN agencies, and finally on the issue of preemptive self-defense, deriving from a broader interpretation of Article 51 of the UN Charter. The second chapter is devoted to the World Trade Organization. The discussion starts from a general examination of WTO law, to then focus on the decision-making process and the repercussions of the consensus requirement on the Organization and its Member States, and finally analyzes the dispute settlement system and the current paralysis of the Appellate Body. In the third and final chapter, the dissertation also aims to investigate the relationship of the United States with an important global actor and international organization, the European Union. The discussion presents a general overview of the transatlantic relationship, illustrating the formal institutions upon which is based the EU-US cooperation, and then it focuses on the current status of the relationship in the various key areas, i.e., trade, security and defense, promotion of democracy, climate change and health.
