Abstract

This study examines the intersection between court-appointed expert witnesses and artificial intelligence, analysing how the doctrinal evolution of this institution is currently grappling with the challenges posed by algorithmic opacity. Starting with a re-examination of the role of the expert witness as an auxiliary to the judge, the study examines the technological and regulatory landscape – with a particular focus on the AI Act and recent national reforms – to assess the resilience of the principles of due process in the face of automated preliminary investigations. The thesis argues that the integration of AI should not result in a delegation of decision-making, but requires a rigorous ‘human reserve’: an anthropocentric paradigm in which constant human oversight (‘human-in-the-loop’) guarantees the transparency, reasoning and constitutional legitimacy of technical assessments in civil proceedings.
