This dissertation examines the regulation of end-of-life decisions within the Italian legal system, tracing how constitutional case law has progressively reshaped the boundaries of Article 580 of the Criminal Code in the continued absence of comprehensive legislation. The first chapter reconstructs the constitutional and civil-law foundations of the debate, starting from the principle of dignity and the right to therapeutic self-determination (Articles 2, 13 and 32 of the Constitution), through the abandonment of the traditional reading of Article 5 of the Civil Code and the case law of the European Court of Human Rights, up to an analysis of the constitutional rulings running from the Cappato case (order no. 207/2018 and judgment no. 242/2019) to the most recent decisions issued between 2024 and 2026, which have consolidated a balancing model between the protection of life and freedom of self-determination. The second chapter focuses on the phenomenon of regional regulatory supplementation, which emerged to fill the gap left by the national legislature, examining the models adopted by Tuscany, Emilia-Romagna and Puglia and questioning the constitutional limits of such interventions in light of the principle of legality in criminal matters, as well as the legal nature — procedural justification or exclusion of typicality — of the non-punishability conditions identified by the Constitutional Court. The third chapter broadens the perspective to the European context, comparatively analysing the legislation of the Netherlands, Belgium, Spain, Switzerland, Germany and France, in order to assess whether a converging trend can be identified in the continental regulation of the matter. The overall aim of the thesis is to bring systematic clarity to an area in which judicial law-making has necessarily had to substitute for legislative action, while also attempting to outline the residual space left for a future comprehensive intervention by the Italian Parliament.
