I finanziamenti europei agli Stati membri e la nuova governance

Abstract

La tesi analizza i finanziamenti europei agli Stati membri, in particolare il programma di finanziamento Next Generation EU, successivo alla crisi pandemica, e il regolamento EDIP per il settore della difesa. Dopo un excursus circa il sistema delle competenze e il processo di integrazione attuato attraverso i trattati, i due interventi vengono analizzati alla luce delle basi giuridiche utilizzate e quindi delle competenze dell'Unione europea in materia di salute, transizione verde e digitale e di tutte le riforme previste dal NGEU e in materia di difesa. Dai riscontri ottenuti si apre una riflessione circa il mutato sistema di governance europea che vede le istituzioni dell'Unione legiferare sempre di più in settori delicati e a trattati invariati.

The thesis examines European Union funding provided to Member States, focusing in particular on the Next Generation EU financing programme introduced in response to the pandemic crisis and on the European Defence Industry Programme (EDIP) regulation in the defence sector. Following an overview of the system of competences and the process of integration implemented through the Treaties, both measures are analysed in light of their legal bases and, consequently, the competences of the European Union in the fields of health, the green and digital transitions, the reforms envisaged under NGEU, and defence. The findings prompt a broader reflection on the evolving system of European governance, whereby EU institutions are increasingly legislating in sensitive policy areas despite the absence of any amendments to the Treaties.
