La mediazione familiare dopo la riforma del processo di famiglia

Abstract

Il seguente elaborato si prefigge l’obbiettivo principale di illustrare l’evoluzione diacronica dell’istituto della mediazione familiare, partendo dalle sue origini e caratteristiche e soffermandosi particolarmente sui mutamenti normativi che questa ha subito, all’interno dell’ordinamento italiano, a seguito della riforma attuata dal decreto legislativo n. 149/2022, evidenziandone, inoltre, le criticità e mettendo in rilievo l’importanza di una soluzione condivisa. La tesi vuole anche dimostrare, implicitamente, quale grande risorsa sia la mediazione familiare, i cui frutti possono essere fruiti tanto dalle famiglie quanto dal sistema giudiziario, con particolare riguardo dell’interesse superiore del minore, a cui è dedicato un intero capitolo.

The following paper has the main purpose of describing the diachronic evolution of the institution of family mediation, starting from its origins and characteristics and focusing, in particular, on the regulatory changes that it has undergone, within the Italian legal system, following the reform implemented by Legislative Decree no. 149/2022, also highlighting its critical issues and emphasizing the importance of a shared solution. The thesis also wants to demonstrate, implicitly, what a great resource family mediation is, whose benefits can be enjoyed by both families and the judicial system, with particular regard to the best interests of the child, to which an entire chapter is dedicated.
