Tendenze evolutive del contenzioso climatico

Abstract

Il contributo restituisce uno spezzato dell'attuale quadro internazionale relativo alle controversie in materia climatica, concentrandosi in particolare sulle ipotesi che si fondano sulla violazione di diritti umani. Partendo dall'illustrazione delle basi scientifiche e normative e ripercorrendo le principale tappe evolutive di tali particolare contenzioso, si arriva infine ad illustrare la sentenza della Corte EDU che ha riconosciuto per la prima volta l'esistenza di un'obbligazione climatica degli Stati, auspicando per il futuro un approccio più collaborativo fra i diversi attori coinvolti.

The contribution provides an overview of the current international context concerning climate-related disputes, with a particular focus on cases based on the violation of human rights. Starting with an illustration of the scientific and regulatory foundations and tracing the key milestones in the evolution of this specific type of litigation, it ultimately discusses the judgment of the European Court of Human Rights, which for the first time recognized the existence of a state's climate obligation, advocating for a more collaborative approach among the various actors involved in the future.
