“Nuptiae horribiles”: indagini sul tema della violenza coniugale nel Regno d’Italia

Abstract

Questo elaborato presenta un'indagine circa la condizione della donna all'interno del nucleo familiare, a partire dal 1861 fino al 1946, individuando nelle fonti giuridiche succedutesi nel tempo i differenti caratteri distintivi delle normative e la loro portata. Il problema della condizione di subalternità della donna rispetto al marito viene affrontato grazie all'approccio casistico e comparativo, da cui emerge una figura femminile costantemente legata al concetto valoriale di onore e, sistematicamente, non tutelata a sufficienza da parte dell'ordinamento. Conclusivamente si può affermare che la violenza coniugale nel Regno d'Italia resti costantemente sullo sfondo della vita delle donne.

This paper presents an investigation into the condition of women within the family unit, starting from 1861 until 1946, identifying the different distinctive characteristics of the regulations and their scope in the legal sources that have followed one another over time. The problem of the condition of subordination of the woman compared to her husband is addressed thanks to the casuistic and comparative approach, from which emerges a female figure constantly linked to the value concept of honor and, systematically, not sufficiently protected by the legal system. Conclusively, it can be stated that marital violence in the Kingdom of Italy remains constantly in the background of women's lives.
