LA TUTELA PENALE DEGLI ANIMALI: NORMATIVA VIGENTE E PROSPETTIVE FUTURE NEL PANORAMA GIURIDICO ITALIANO

Abstract

Il presente elaborato analizza in modo approfondito la normativa penale italiana dedicata alla tutela degli animali, evidenziandone le potenzialità e le criticità. Lo studio esamina le principali disposizioni attualmente in vigore, soffermandosi sulle figure di reato cardine e sulle pronunce giurisprudenziali che ne hanno plasmato l'applicazione concreta. Attraverso un approccio critico e sistematico, vengono indagate le lacune del quadro normativo e la sua capacità di rispondere alle crescenti richieste di protezione degli animali come esseri senzienti. Un’attenzione particolare è riservata alle prospettive di riforma, con l’analisi delle proposte legislative in discussione, valutandone l’impatto sulla prevenzione di condotte criminose e sul rafforzamento delle misure deterrenti. L’obiettivo è individuare un percorso che consenta al diritto penale non solo di reprimere i reati, ma anche di promuovere un cambiamento culturale con un approccio più lungimirante. Questa ricerca, combinando l’analisi normativa e giurisprudenziale con uno sguardo alle riforme future, mira a individuare un sistema più efficace e coerente, capace di garantire una protezione diretta e inclusiva, rispondendo alle esigenze etiche e giuridiche di una società sempre più attenta al benessere animale.

This work provides an in-depth analysis of the Italian criminal law framework dedicated to the protection of animals, highlighting its strengths and shortcomings. The study examines the key provisions currently in force, focusing on the main criminal offenses and the judicial rulings that have shaped their practical application. Through a critical and systematic approach, it explores the gaps in the current legal framework and its ability to address the growing demands for the protection of animals as sentient beings. Particular attention is given to reform prospects, analyzing the legislative proposals under discussion and assessing their impact on preventing criminal conduct and strengthening deterrent measures. The aim is to outline a pathway that enables criminal law not only to punish offenses but also to foster cultural change through a more forward-looking approach. This research, through combining normative and jurisprudential analysis with a forward-thinking perspective on reforms, seeks to identify a more effective and coherent system capable of ensuring direct and inclusive protection, by meeting the ethical and legal expectations of a society increasingly attentive to animal welfare.
