Codice Rosso e rafforzamento del ruolo della persona offesa nel procedimento penale.

Abstract

Nel presente lavoro si affronta il tema particolarmente attuale, anche a livello internazionale, della violenza di genere. Così, l’elaborato si divide in due parti: la prima dedicata all’iter storico intrapreso dall’ordinamento giuridico italiano per contrastare il fenomeno della violenza di genere, soffermandosi sulla normativa c.d. "Codice Rosso" contenuta nella l. 19 luglio 2019, n. 69 e sugli interventi legislativi internazionali adottati per farvi fronte; una seconda incentrata sulla figura della persona offesa in ambito processuale, analizzando, dunque, le principali modifiche apportate al Codice di Procedura Penale e il rafforzamento cautelare operati dalla suddetta normativa l. 19 luglio 2019, n. 69, nonché l’ulteriore potenziamento cautelare posto in essere dalla recente normativa l. 24 novembre 2023, n. 168. Pertanto, nel suo complesso, codesto lavoro tratta principalmente l'impatto del “Codice Rosso” sulle garanzie e sui diritti della persona offesa, nonché la sua efficacia nel predisporre una tutela effettiva delle vittime di reato all’interno del sistema di giustizia penale.

In this work we address the particularly current topic, also at the level international, gender violence. Thus, the essay is divided into two parts: the first dedicated to the historical process undertaken by the Italian legal system to combat the phenomenon of gender violence, focusing on the so-called legislation "Code Red" contained in the law. 19 July 2019, n. 69 and on the international legislative interventions adopted to deal with them; a second focused on the figure of the offended person in the procedural context, therefore analyzing the main ones changes made to the Code of Criminal Procedure and the precautionary strengthening carried out by the aforementioned legislation l. 19 July 2019, n. 69, as well as further strengthening precautionary measure put in place by the recent legislation l. 24 November 2023, n. 168. Therefore, as a whole, this work mainly deals with the impact of the “Code Red” on the guarantees and rights of the injured person, as well as its effectiveness in provide effective protection for crime victims within the justice system criminal.
