Reato di Abuso d'ufficio, situazione attuale e prospettive future.

Abstract

In questa tesi di laurea ho analizzato in modo approfondito, come si può cogliere dal titolo della stessa, il delitto di abuso d’ufficio. Un reato che è sempre stato, fin dall’entrata in vigore del Codice penale, oggetto di grandi critiche, che nell’ultimo anno si sono concretizzate nel disegno di legge “Nordio”, n. 808 del 2023, attualmente all’esame della Camera dei Deputati, che ha come obiettivo l’abrogazione del delitto dall’ordinamento italiano. L’analisi del reato sarà diretta a compiere alcune previsioni sul futuro del delitto stesso, per capire se effettivamente sia necessario sopprimere questa fattispecie oppure sia più opportuno intervenire riscrivendo la disposizione. Per portare a termine il compito appena delineato si è deciso di suddividere lo scritto in cinque capitoli, tesi ad esaminare in modo più accurato possibile l’articolo 323 del codice penale. Nel primo capitolo si tratterà l’abuso d’ufficio in prospettiva storica, partendo dalla formulazione presente nel codice “Zanardelli” del 1889, soffermandosi poi sulle vicissitudini che hanno coinvolto l’articolo 323 del codice del 1930, e concludendo con gli interventi più recenti, che hanno portato alla versione attualmente in vigore. Successivamente, nel capitolo II si approfondirà il dibattito che si è creato sull’abuso d’ufficio, tra chi ritiene che sia necessario abolirlo e chi, per converso, ne valorizza l'utilità. Si proseguirà con l’analisi, all’interno del terzo capitolo, dell’attività della diciottesima e della diciannovesima legislatura sull’articolo 323 c.p. che ha portato al d.d.l. 808 del 2023. Nel quarto capitolo, poi, lo sguardo si sposterà da una dimensione nazionale a quella internazionale, andando anche a compiere un indagine comparata del reato. Indagine comparata che sarà funzionale a delineare una riforma alternativa, compito che si svolgerà nel quinto capitolo.

In this degree thesis I have analyzed in depth, as can be seen from its title, the crime of abuse of functions. A crime that has always been, since the "birth" of the Criminal Code, the subject of great criticism, which in the last year has materialized in the "Nordio" d.d.l., n. 808 of 2023, currently under examination by the Chamber of Deputies, which aims to repeal the crime from Italian law. The analysis of the crime will be aimed at making some predictions about the future of the crime itself, to understand whether it is actually necessary to eliminate this case or whether it is more appropriate to intervene by rewriting the provision. To complete the task just outlined, i decided to divide the writing into five chapters, aimed at examining article 323 of the penal code as accurately as possible. In the first chapter we will discuss the abuse of office in a historical perspective, starting from the formulation present in the "Zanardelli" code of 1889, then focusing on the vicissitudes that involved article 323 of the 1930 code, and concluding with the most recent interventions , which led to the version currently in force. Subsequently, in Chapter II we will delve deeper into the debate that has arisen on abuse of office, between those who believe that it is necessary to abolish it and those who, conversely, value its usefulness. We will continue with the analysis, within the third chapter, of the activity of the eighteenth and nineteenth legislature on article 323 of the criminal code. which led to the bill 808 of 2023. In the fourth chapter, then, the gaze will move from a national to an international dimension, also carrying out a comparative investigation of the crime. Comparative investigation that will be functional to outline an alternative reform, a task that will take place in the fifth chapter.
