Il procedimento di adesione UE: i rapporti con la Turchia

Abstract

Il presente elaborato intende esaminare il procedimento di adesione, disposto nell’articolo 49 TUE, e l’evoluzione che questo ha avuto dal 1951 – anno dell’istituzione della prima comunità europea, la CECA – ad oggi, facendo buon uso, inoltre, dell’esempio della mancata adesione della Turchia che ha messo in luce gli strumenti e i criteri a disposizione ma al contempo alcuni difetti del procedimento stesso e alcune mancanze che poi in seguito sono state colmate. In aggiunta, questo elaborato presenta un ulteriore elemento, ossia il diritto di recesso dall’Unione europea, di cui all’articolo 50 TUE, prendendo in esame il diritto di recesso prima della disposizione inserita nel Trattato di Lisbona e successivamente analizzandola paragrafo per paragrafo. Infine, sempre per quanto riguarda il diritto di recesso, si è deciso di inserire la Brexit: primo e unico esempio di applicazione dell'articolo 50 TUE.

The purpose of this paper is to examine the accession procedure laid down in Article 49 TEU and the progress made since 1951 - the year of the establishment of the first European Community, the ECSC - to date, making good use of this procedure, furthermore, the example of the non-accession of Turkey which highlighted the instruments and criteria available but at the same time some defects of the procedure itself and some shortcomings that were later filled. In addition, there is another element to this report, namely the right of withdrawal from the European Union, as set out in Article 50 TEU, considering the right of withdrawal before the provision in the Lisbon Treaty and then analysing it paragraph by paragraph. Finally, as regards the right of withdrawal, it was decided to include Brexit: the first and only example of application of Article 50 TEU.
