La vendita diretta degli immobili pignorati nella riforma Cartabia

Abstract

La trattazione affrontata in questa tesi si pone l’obiettivo di evidenziare in quale ampia misura, negli ultimi anni, la disciplina delle esecuzioni immobiliari sia stata segnata da profonde modifiche ed aggiornamenti, tutti finalizzati a rendere più celere la procedura esecutiva. Con la recente Riforma Cartabia, introdotta dal D.Lgs. n. 149 del 10 ottobre 2022, il legislatore è nuovamente intervenuto nel settore esecutivo perseguendo gli obiettivi di semplificazione, speditezza e razionalizzazione del processo civile, nel rispetto della garanzia del contraddittorio e attenendosi ai principi e criteri direttivi previsti dalla stessa legge. Tra le modifiche che hanno investito la materia dell’esecuzione forzata, le più corpose riguardano la procedura di vendita, ed in particolar modo la mia tesi si occupa dell’esecuzione immobiliare: si analizzano alcuni aspetti della materia che sono stati oggetto dell’intervento legislativo, tra i quali la possibilità di delegare le attività di vendita ad un professionista, e quindi esaminando il ruolo del Professionista Delegato e il progressivo ampliamento dei poteri affidati in capo a tale figura. L’oggetto principale su cui verterà la presente tesi di ricerca è tra tutte, quella che si può definire la più rilevante novità introdotta dalla Riforma Cartabia, ovvero l’introduzione della nuova fattispecie della cosiddetta “vendita diretta”, istituto del quale non si può negare il carattere innovativo, quantomeno all’interno del nostro ordinamento, ispirato al modello francese della “vente privée”: un nuovo meccanismo di vendita, che per la prima volta ricerca la speditezza anche mediante la collaborazione del debitore al sistema della vendita giudiziale.

This thesis aims to highlight the extent to which the discipline of real estate executions has undergone profound changes and updates in recent years, all aimed at expediting the enforcement procedure. With the recent Cartabia Reform, introduced by Legislative Decree No. 149 of October 10, 2022, the legislator has once again intervened in the enforcement sector, pursuing the objectives of simplification, speed, and rationalization of civil procedure, while respecting the guarantee of adversarial proceedings and adhering to the guiding principles and criteria set forth by the same law.

Among the changes affecting the field of forced execution, the most significant pertain to the sales procedure. In particular, my thesis focuses on real estate execution, analyzing several aspects of the matter that have been the subject of legislative intervention, including the possibility of delegating sales activities to a professional, and thus examining the role of the Delegated Professional and the progressive expansion of powers entrusted to this figure.

The main subject of this research thesis is, among all the changes, what can be considered the most significant novelty introduced by the Cartabia Reform: the introduction of the new concept of "direct sale," an institution whose innovative nature cannot be denied, at least within our legal system, inspired by the French model of "vente privée." This new sales mechanism seeks speed for the first time through the collaboration of the debtor in the judicial sale system.
