Diritti fondamentali e ambiente nella giurisprudenza delle Corti sovranazionali

Abstract

La tesi si propone di condurre un'analisi comparativa della giurisprudenza della Corte Europea dei Diritti dell'Uomo, della Corte Interamericana dei Diritti Umani e della Corte di Giustizia dell'Unione Europea in materia di diritti umani e ambiente. Dopo un breve excursus storico, l'elaborato si concentra sull'osservazione e l'analisi dei diversi approcci al rapporto tra diritti umani e ambiente, con particolare attenzione al cosiddetto diritto a un ambiente sano. Infine, il lavoro esamina tre casi significativi trattati dalle suddette corti, al fine di cogliere le differenze e le somiglianze nei loro approcci. Infine, la tesi cerca di proporre alcune soluzioni per il futuro.

The thesis aims to conduct a comparative analysis of the jurisprudence of the European Court of Human Rights, the Inter-American Court of Human Rights, and the Court of Justice of the European Union regarding human rights and the environment. Following a brief historical overview, the paper focuses on observing and analyzing the various approaches to the relationship between human rights and the environment, with particular emphasis on the right to a healthy environment. Finally, the study examines three significant cases from these courts to identify differences and similarities in their approaches. Ultimately, the thesis seeks to propose some solutions for the future.
