La riforma dello Sport 2023: analisi critica della normativa con riferimento alle problematiche attuali e ai provvedimenti futuri

Abstract

L’attività sportiva nel nostro paese è cominciata prima dell’Unità d’Italia e nel corso degli anni si è strutturata e ha avuto bisogno di norme ad hoc. Negli anni recenti il problema maggiore è stato quello che riguarda la divisione che si era creata tra il settore del dilettantismo e quello del professionismo. Per quest'ultimo era stata adottata una normativa che disponeva tutte le regole sia per quanto riguarda le società, sia per gli atleti, che per i lavoratori. Il settore del dilettantismo aveva dei vuoti normativi ed esigeva delle nuove regole. Fu così che cominciò nel 2019 l'iter legislativo che porterà poi ai 5 decreti legislativi del 2021 inerenti alla riforma dello sport, entrati poi in vigore a metà 2023. L'elaborato si divide in quattro capitoli che trattano sia nella storia evolutiva dell'attività sportiva, che della Riforma dello Sport. Quest'ultima verrà analizzata in tutti gli aspetti. Infatti se ne comincerà a parlare partendo dalla legge delega del 2019 che ha delegato il legislatore a intervenire sulla materia; successivamente verranno trattati i Decreti legislativi incentrati sul lavoratore sportivo e sul RAS (Registro Nazionale delle Attività Sportive); e, infine, si analizzeranno i pareri delle varie persone coinvolte, dalle Federazioni, ai lavoratori, per concludere con un'intervista al dirigente della società sportiva genovese "A.S.D. Nuotatori Genovesi". Per il 2024 si aspettano nuove direttive, in particolare il legislatore deve specificare altre categorie di lavoratori che rientrano nella nuova disciplina dello sport e i dirigenti sportivi e le società stanno aspettando che il RAS diventi operativo.

Sporting activity in Italy began before the unification of the country, and over the years, it has become structured and has required specific regulations. In recent years, the major issue has been the division that had arisen between the amateur sector and the professional sector. For the latter, legislation was adopted that established all the rules concerning the clubs, the athletes, and the workers. The amateur sector had regulatory gaps and demanded new rules. Thus, the legislative process began in 2019, leading to the five legislative decrees of 2021 related to the sports reform, which then came into effect in mid-2023. The paper is divided into four chapters that deal with both the evolutionary history of sporting activity and the Sports Reform. The latter will be analyzed in all aspects. Indeed, the discussion will start from the 2019 delegate law that authorized the legislator to intervene in the matter; subsequently, the legislative decrees focused on the sports worker and on the RAS (National Register of Sports Activities) will be addressed; and, finally, the opinions of various stakeholders will be analyzed, from Federations to workers, concluding with an interview with the manager of the Genoese sports club "A.S.D. Nuotatori Genovesi." For 2024, new directives are expected, in particular, the legislator needs to specify other categories of workers that fall under the new sports discipline, and sports executives and clubs are waiting for the RAS to become operational.
