Il Diritto di Prelazione: Il caso dell'Isola Gallinara

Abstract

Il presente elaborato nasce da un interesse personale per la regione Liguria. A livello globale, la Liguria è conosciuta per la sua riviera ma spesso viene nominata l’isola Gallinara e tutte le sue peculiarità. Questa indagine, non si sofferma sugli aspetti caratteristici dell’isola ma si propone di analizzare a fondo la vicenda giuridica che la vide protagonista nel 2020, quando un magnate ucraino tentò di acquistarla. L’Italia, come ben sappiamo, è il primo paese al mondo con il maggior numero di siti iscritti nella lista del patrimonio mondiale UNESCO e di fatti esistono molte vicende giuridiche legate al diritto di prelazione dei beni culturali. La tesi offre un prospetto finale sulle leggi in fatto di prelazione artistica in Italia e più precisamente, si ricercano le ragioni che hanno spinto il Ministero della Cultura ad esercitare la prelazione artistica e se questa sia legittima. Per garantire una prospettiva più chiara e precisa possibile sono state consultate diverse fonti, tra cui diari di viaggio, sentenze, verbali di congressi, leggi italiane e leggi internazionali. Lo scopo principale è spiegare/insegnare cosa significa diritto di prelazione artistica e perché a volte è complicata, prendendo come esempio la storia giuridica dell'Isola Gallinara. Numerosi personaggi storici hanno avuto l'opportunità di stabilirsi per un certo periodo in questo luogo enigmatico. Nonostante sia disabitata, l’isola è così affascinante che le sue coste frastagliate hanno attirato anche un magnate ucraino. I tre capitoli mirano a fornire in maniera dettagliata ed esaustiva il contesto storico dell'isola, la realtà giuridica ad essa legata e la situazione attuale.

The present work originates from a personal interest in the Liguria region. Liguria, while being known mainly for its Riviera, Gallinara island is often mentioned. This investigation rather than focusing on the island's peculiarities, analyzes in depth the legal case that made this little island a protagonist in 2020; when a Ukranian tycoon attempted to purchase it. Italy is the first country in the world with the largest number of sites registered in the UNESCO World Heritage list. It is comprehensible why there are many legal issues linked to the preemptive right of cultural heritage. The thesis offers a perspective on the laws regarding artistic pre-emption in Italy. More precisely, it investigates the causes that pushed the Ministry of Culture to exercise artistic pre-emption on the island and whether this was legitimate. Various sources were consulted to ensure the clearest and most precise perspective possible, including travel diaries, judgments, Italian laws, and international laws. The main aim is to explain what artistic preemptive right means and why it may be a complex issue, taking the legal history of Gallinara Island as an example. Numerous historical figures had the opportunity to settle for a certain period in this enigmatic place. Despite being uninhabited, the island is so fascinating that its coasts attracted a Ukrainian tycoon. Finally, the main aim is to provide exhaustively the historical context of the island, the legal reality linked to it, and the current situation.
