I conflitti di interesse nella disciplina anticorruzione

Abstract

La tesi tratta il tema del conflitto di interessi, analizzandone la disciplina e le relative problematiche a partire dalla Costituzione, e proseguendo con il Codice di comportamento dei dipendenti pubblici, il Codice dei contratti pubblici, il decreto legislativo 39 del 2013, la legge 215 del 2004, l'art 53, comma 16-ter del decreto legislativo n. 165 del 2001, e altre situazioni particolari che possono portare ad un conflitto di interessi. Inoltre si fa riferimento al ruolo svolto dall'ANAC e dal RPCT in materia, i relativi poteri, e il rapporto che intercorre tra loro nell'accertamento delle inconferibilità e incompatibilità. In ultimo, la tesi si conclude con la recente proposta del 4 maggio 2023 da parte della Commissione europea e dell' Alto rappresentante, che presenta alcune nuove misure per contrastare la corruzione, non solo a livello europeo, ma anche a livello mondiale.

The thesis deals with the issue of conflict of interest, analyzing the discipline and related problems starting from the Constitution, and continuing with the Code of Conduct for Public Employees, the Code of Public Contracts, Legislative Decree 39 of 2013, Law 215 of 2004, Article 53, paragraph 16-ter of Legislative Decree n. 165 of 2001, and other special situations that may lead to a conflict of interest. In addition, the role played by ANAC and the RPCT in the matter, their powers, and the relationship between them in ascertaining ineligibility and incompatibility are addressed. Finally, the thesis concludes with the recent proposal of 4 May 2023 by the European Commission and the High Representative, which presents some new measures to combat corruption, not only at the European level, but also at the global level.
