NUOVE FUNZIONALITÀ DELLA FASE PREPARATORIA NELLA RECENTE RIFORMA DEL PROCESSO CIVILE. SPUNTI DI RAFFRONTO COMPARATO.

Abstract

La presente indagine intende affrontare il tema della fase preparatoria del processo civile, sia in ottica comparata con l'analisi delle soluzioni normative utilizzate in Francia, Inghilterra, Spagna e Stati Uniti, sia da un punto di vista storico, ripercorrendo l'evoluzione della disciplina degli atti introduttivi e della trattazione in senso stretto negli Stati preunitari e nell'Italia unita. Si compie, infine, una disamina delle innovazioni introdotte con la recente riforma Cartabia al fine di ridurre i tempi e i costi del processo e delle possibili discrasie applicative e criticità di sorta che potrebbero presentarsi.

The paper illustrates the pretrial phase of the civil procedural law, both in comparison perspective with the analysis of the solutions used in France, England, Spain and the United States, and from a historical point of view, retracing the evolution of the discipline of the pleadings and pretrial in the pre-unification States and in Italy. Finally, an examination is carried out of the innovations introduced with the recent Cartabia reform in order to reduce the times and costs of the process and the possible dyscrasic applications and critical issues.
