Abstract

Questa tesi si propone di esaminare il delitto di atti persecutori, codificato all'art. 612-bis c.p. e più comunemente noto come "stalking". Il primo capitolo è dedicato ad un'analisi introduttiva del fenomeno, con un' attenzione particolare rivolta ai dubbi di costituzionalità sorti in seguito alla sua introduzione. Inoltre, viene svolta una breve analisi circa le normative anti-stalking adottate in altri ordinamenti sia extraeuropei che europei. Si analizzano anche le ricerche di Harald Ege, mettendo in evidenza le differenze tra stalking, mobbing e straining. Nel secondo capitolo viene fornita un'analisi dettagliata della disposizione. Vengono in particolare approfonditi il bene giuridico tutelato dalla norma incriminatrice, gli elementi oggettivi e soggettivi del reato nonché le circostanze aggravanti. Nel terzo capitolo vengono esposti in sintesi gli aspetti procedurali. Infine, nel capitolo quarto si effettua un'analisi comparativa tra l'articolo 612-bis c.p. e altre figure criminose, come i maltrattamenti in famiglia, la violenza privata e l'omicidio aggravato.

This thesis aims to examine the crime of persecutory acts, codified in Article 612-bis of the Criminal Code and more commonly known as 'stalking'. The first chapter is devoted to an introductory analysis of the phenomenon, with particular attention paid to the constitutionality doubts that have arisen since its introduction. In addition, a brief analysis is made of the anti-stalking legislation adopted in other non-European and European legal systems. Harald Ege's research is also analysed, highlighting the differences between stalking, mobbing and straining. The second chapter provides a detailed analysis of the provision. In particular, the legal asset protected by the offence provision, the objective and subjective elements of the offence, as well as the aggravating circumstances are examined. The third chapter summarises the procedural aspects. Finally, chapter four provides a comparative analysis between Article 612-bis of the Criminal Code and other criminal offences, such as domestic violence, private violence and aggravated murder.
