La procreazione medicalmente assistita nel cattolicesimo, nell’islamismo e nell’ebraismo. Un’analisi in prospettiva comparata.

Abstract

Il presente elaborato è incentrato sul tema della procreazione medicalmente assistita (PMA), con focus sull’orientamento del cattolicesimo, dell'islamismo e dell'ebraismo circa questa materia delicata caratterizzata da un dato fenomenico in continua crescita. La normativa vigente italiana sulla PMA, la legge 40/2004, è frutto di un lungo e tortuoso percorso. Risultata sin da subito lacunosa e limitante è stata oggetto di numerose revisioni da parte della Corte Costituzionale che ne ha modificato via via l’impianto. La ricerca affronta, in primis, la visione della Chiesa Cattolica che risulta essere particolarmente rigida sulle modalità procreative artificiali; seguita dall’Islam e dall’Ebraismo, le quali, al contrario, in caso di difficoltà procreative, ben incoraggiano tali tecniche. La struttura dell’elaborato in ottica comparata permette di ben comprendere le affinità e le differenze di idee e valori che intercorrono tra le tre confessioni religiose in oggetto.

This paper focuses on the topic of medically assisted procreation (MAP), with a focus on the orientation of catholicism, islamism and judaism on this delicate subject characterised by a phenomenal data in continuous growth. The current Italian legislation on the PMA, Law 40/2004, is the result of a long and tortuous path. It was immediately found to be deficient and limiting, and it has been the subject of several amendments by the Constitutional Court, which has gradually changed its structure and its content. The research deals, first of all, with the vision of the Catholic Church which turns out to be particularly rigid on the artificial procreative methods; followed by Islam and Judaism, which, on the contrary, well encourage these techniques in the event of procreative difficulties. The structure of the report in a comparative perspective allows us to clearly understand the affinities and differences of ideas and values that exist between these three religions.
