La compatibilità tra i regolamenti Bruxelles IIbis e Dublino III nella recente giurisprudenza della Corte di giustizia

Il lavoro svolto nella tesi verte sull'analisi del diritto dell’Unione europea, precisamente sul Regolamento Bruxelles II-bis e il sistema di Dublino, attraverso un approccio dapprima teorico, terminando con l’analisi di una realtà specifica. Punto cardine del primo capitolo è il “best interest of the child”; la Convenzione sui diritti del fanciullo del 1989 e la Dichiarazione universale dei diritti del fanciullo del 1959 delineano i principi fondamentali della tutela minorile.
Il secondo capitolo presenta il quadro di normativa europea necessario per l’analisi della causa successiva. Il Regolamento Bruxelles II-ter è considerato la “pietra angolare” del diritto internazionale privato e processuale, mentre il cosiddetto “Sistema di Dublino”, in particolare il Regolamento 604/2013, rappresenta la “colonna portante” del Sistema europeo comune di asilo, affinato dal Regolamento Eurodac e diverse Direttive.
L’ultimo capitolo prende in esame la causa C-262/PPU: la domanda di pronuncia pregiudiziale verte sull’interpretazione dell’articolo 2 del Regolamento Bruxelles II-bis. The subject of this thesis focuses on the analysis of European Union law, specifically on the Brussels II-bis Regulation and the Dublin system,
through a theoretical approach, ending with the analysis of a specific reality. The cornerstone of the first chapter is the "best interest of the child"; the 1989 Convention on the Rights of the Child and the 1959 Universal Declaration of the Rights of the Child outline the fundamental principles of child protection.
The second chapter presents the necessary European regulatory framework for the analysis of the next case. The Brussels II-ter Regulation is considered the "cornerstone" of private and procedural international law, while the so-called "Dublin System", in particular Regulation 604/2013, represents the "backbone" of the Common European Asylum System, refined by the Eurodac Regulation and several Directives.
The last chapter examines Case C-262/PPU: the reference for a preliminary ruling concerns the interpretation of Article 2 of the Rules of Procedure Brussels II-bis.
