L'EREDITÀ DIGITALE

Abstract

Il progressivo sviluppo tecnologico ha ridisegnato i confini della realtà, sottoponendo all'esperienza giuridica nuovi scenari da regolare. L'elaborato affronta il tema della successione mortis causa del patrimonio digitale ripercorrendo l'evoluzione normativa in materia e soffermandosi sui principali strumenti utilizzati per la trasmissione dei digital assets. Viene evidenziato l'intricato rapporto tra diritto all'accesso e tutela della privacy, richiamando l'attenzione sulle condizioni generali di contratto imposte dai fornitori di servizi online. Quest'ultime, infatti, implicano una cessione dei dati personali, sollevando interrogativi sul bilanciamento tra il diritto di accedere ai servizi digitali e la necessità di proteggere la sfera privata degli utenti. La discussione dei profili problematici sottesi al caso in esame è accompagnata dall'analisi della recentissima giurisprudenza di merito emersa in ambito nazionale.

The Progressive technological development has redesigned the boundaries of reality, subjecting new scenarios to be regulated by lawmakers. The thesis addresses the theme of digital inheritance mortis causa by retracing the regulatory evolution on the subject and focusing on the main legal tools used for the transfer of digital assets. The intricate relationship between the right to access and protection of privacy is highlighted, drawing attention to the general contract conditions imposed by online service providers. The latter, in fact, imply a transfer of personal data, raising questions about the balance between the right to access digital services and the need to protect the privacy of users. The discussion of the problematic aspects underlying the case in question is accompanied by the analysis of the very recent jurisprudence emerged nationally.
