Violenza sessuale ed il consenso femminile nella cultura giuridica tra Ancien Régime e contemporaneità

Abstract

La violenza sessuale è un fenomeno che ha coinvolto – e continua a coinvolgere - epoche storiche e culture diverse. Le fonti pervenute riportano un quadro di come essa veniva avvertita e giudicata, in maniera spesso influenzata dalle regole sociali e dalla cultura dell'epoca. Presso molte società, infatti, essa era una pratica diffusa e perfino accettata. Questo elaborato mira a ripercorrere sia storicamente che giuridicamente il tema della violenza sessuale e del consenso all’atto sessuale da parte della donna, attraverso un’analisi del periodo intercorrente tra l’Antico Regime e l’età contemporanea. In particolare, la tesi esplora l’evoluzione del concetto di consenso, soffermandosi su come lo stesso sia stato influenzato da fattori sociali, culturali e giuridici. Durante questo percorso, inoltre, sono state analizzate altre tematiche importanti come i concetti di onestà e di violenza.

Sexual violence is a phenomenon that has involved - and continues to involve - different historical periods and cultures. The sources received report a picture of how it was perceived and judged, often influenced by the social rules and culture of the time. In many societies, in fact, it was a widespread and even accepted practice. This paper aims to retrace both historically and legally the theme of sexual violence and consent to sexual intercourse by women, through an analysis of the period between the Ancien Régime and the contemporary age. In particular, the thesis explores the evolution of the concept of consent, focusing on how it has been influenced by social, cultural and legal factors. During this journey, moreover, other important issues such as the concepts of honesty and violence have been analyzed.
