Un nuovo "approdo": la ricerca di un porto sicuro tra fonti sovranazionali, internazionali e interne

Abstract

Lo scopo di questa tesi consiste in un'indagine sulla nozione di "place of safety" all'interno di un quadro normativo ampio, tuttavia insufficiente e incompleto. Dopo un'analisi delle varie fonti internazionali, sovranazionali e interne (Capitolo I), ci si soffermerà sulla definizione di "place of safety", esaminando alcuni casi rilevanti e cercando di individuare una modalità accettabile di designazione (Capitolo II). Di seguito, si propone un focus sulla figura, sempre più protagonista, del comandante della nave (Capitolo III). All'interno del Capitolo IV, poco prima della conclusione, si proporrà una riflessione, seppur breve, su alcuni punti dolenti che sono emersi alla luce di quest'indagine. Infine, nelle conclusioni, vengono analizzate le ultime prospettive in materia di immigrazione dal punto di vista internazionale, sovranazionale e nazionale.

The purpose of this thesis relies in an investigation on the notion of "place of safety" inside a normative system wide, yet incomplete and insufficient. After an analysis on the international, supranational and internal sources (Chapter I), it will be given a definition of "place of safety", by examining some relevant cases and trying to identify an acceptable mode to designate it (Chapter II). After that, it is proposed a focus on the figure of the shipmaster, more and more relevant (Chapter III). In Chapter IV, just before the conclusions, it will be given a reflection, although short, on some sore points that have emerged in this investigation. At the end, in the conclusions will be analyzed the latest prospectives in the migration matter internationally, supranational and nationally
