La responsabilità penale del medico dalla legge Gelli Bianco all'emergenza sanitaria

Abstract

L’elaborato si promette di ripercorrere le norme succedutesi in materia di responsabilità penale del medico, così da poter valutare la validità della normativa attuale ed eventualmente l’opportunità di una nuova disciplina in materia. L'analisi critica parte dalle due riforme introdotte nel 2012 e nel 2017, il decreto Balduzzi e la legge Gelli Bianco. Una volta sottolineate peculiarità e problematiche dei due interventi, si passa all’esame del nuovo contesto pandemico e delle disposizioni introdotte con il decreto-legge 44/2021 per fronteggiare l’emergenza sanitaria da SARS-CoV-2.

The paper has two main purposes. It retraces the different rules on the doctor's criminal liability and then it tries to evaluate the validity of the current legislation and possibly the opportunity of a new discipline on the subject. The critical analysis starts from the two reforms introduced in 2012 and 2017, the Balduzzi decree and the Gelli Bianco law. Once the peculiarities and problems of the two interventions have been highlighted, it moves on to the examination of the new pandemic context and the provisions introduced with the decree-law 44/2021 to deal with the SARS-CoV-2 health emergency.
