dc.description.abstract | Quando il COVID-19 ha varcato la soglia delle carceri del Paese, il sistema penitenziario italiano ha messo in luce le sue più grandi fragilità. Il sovraffollamento e le carenze strutturali di molti istituti hanno reso impossibile attuare forme di “distanziamento sociale” efficaci alla prevenzione del contagio da Coronavirus.
L’obbiettivo di questo elaborato consiste in un’analisi delle principali misure anti-Coronavirus adottate dal Legislatore, concernenti il sistema penitenziario italiano. La riflessione intende, altresì, concentrarsi sull’efficacia di tali interventi e sulle conseguenze che hanno avuto sui diritti fondamentali dei detenuti.
L’emergenza sanitaria ha messo ulteriormente in crisi il concetto di pena e di carcere, che, in qualità “istituzione totale”, ha dato adito ad accesi dibattiti pubblici, i quali hanno tentato di rispondere ai seguenti interrogativi: i diritti fondamentali dei detenuti, in primis il diritto alla salute, sono stati effettivamente tutelati? Fino a che punto i principi fondamentali di un ordinamento democratico, quale il nostro, possono imporre limiti al potere statuale nell’intervenire a tutela dell’ordine pubblico? | it_IT |
dc.description.abstract | When COVID-19 crossed the threshold of the italian prisons, the country’s penitentiary system showed its deep fragility. Overcrowding and structural deficiencies in many institutes made impossible to implement forms of "social distancing" to prevent Coronavirus illness
The health emergency created problems in order to the concept of punishment and prison, that heated public debates, which tried to answer the following questions: have the fundamental rights of prisoners, primarily the right to health, been actually protected? Can the fundamental principles of a democratic system impose limits on public power in intervening to protect public order?
The purpose of this paper consists of an analysis of the main anti-Coronavirus laws adopted by the Government, concerning the Italian prison’system. The reflection wants to focus on the effectiveness of these interventions and the consequences they have had on the fundamental rights of prisoners. | en_UK |
