La corruzione nel settore privato

Abstract

Oggetto della mia tesi è l'analisi del fenomeno corruttivo in ambito privato, ossia tra soggetti che non rivestono cariche o funzioni pubbliche. Ho descritto le normative internazionali ed europee che hanno iniziato, a partire dagli anni '90 del secolo scorso, a regolare la materia, e le conseguenti riforme legislative emanate dal legislatore italiano per adeguarsi a tali fonti sovranazionali. Mi sono poi concentrata sugli elementi fondamentali dell'art. 2635 del Codice civile, che a partire dal 2002 regola nel nostro ordinamento il reato di corruzione tra privati. Infine, ho analizzato il rapporto intercorrente tra tale fattispecie e il Decreto n. 231/2001 disciplinante la responsabilità amministrativa dipendente da reato degli enti privati.

The subject of my thesis is the analysis of the phenomenon of corruption in the private sphere, that is, among individuals who do not hold public office or functions. I described the international and european regulations that began, starting in the 1990s of the last century, to regulate the matter, and the subsequent legislative reforms enacted by the Italian legislature to adapt to these supranational sources. I then focused on the basic elements of Article 2635 of the Civil Code, which since 2002 has regulated the crime of bribery among private individuals in our system. Finally, I analyzed the relationship between this case and Decree No. 231/2001 regulating the administrative liability of private entities arising from crimes.
