Luci e ombre del DDL Zan

Abstract

L’intenzione di approfondire il tema della tutela contro le discriminazioni e la violenza omotransfobica è nata dopo aver partecipato al corso di “Introduzione agli studi di genere”, che ho affrontato non solo come un esame da dover superare ma soprattutto per conoscere un ambito di studi che per me era pressoché sconosciuto. È stata anche l’occasione per prendere parte a discussioni: una pratica a cui sono abituato. Ho la fortuna, infatti, di essere cresciuto in una famiglia molto eterogenea in cui le idee, se espresse in modo educato e civile, si potevano confrontare senza pregiudizi o ritorsioni anche se spesso erano diametralmente opposte. Il tema delle discriminazioni basate sull’orientamento sessuale o sull’identità di genere è ancora molto divisivo nel nostro paese: lo dimostra l’accidentato iter legislativo che ha segnato il tentativo di estendere a queste forme di discriminazioni alcune forme di tutela penale già previste nella maggior parte degli altri ordinamenti europei. Mi riferisco al DDL Zan, passato alla Camera il 4 novembre 2020 nel e poi bocciato l’anno successivo al Senato.

The intention to deepen the theme of protection against discrimination and homotransphobic violence was born after participating in the course of "Introduction to gender studies", which I faced not only as an exam to be passed but above all to know a field of study that was almost unknown to me. It was also an opportunity to take part in discussions: a practice I am used to. I am fortunate, in fact, to have grown up in a very heterogeneous family in which ideas, if expressed in a polite and civil way, could be confronted without prejudice or retaliation even if they were often diametrically opposed. The issue of discrimination based on sexual orientation or gender identity is still very divisive in our country: this is demonstrated by the bumpy legislative process that marked the attempt to extend to these forms of discrimination some forms of criminal protection already provided for in most other European legal systems. I refer to the DDL Zan, passed in the Chamber on November 4, 2020 in the and then rejected the following year in the Senate.
