Violenza carnale e tutela dell'onorabilità femminile: il matrimonio riparatore nella tradizione giuridica italiana.

Abstract

Questa tesi ha come obiettivo l'esame della famiglia patriarcale dal Medioevo fino al Novecento, facendo attenzione al ruolo del pater familias, al valore della donna e alla reputazione della sua stessa famiglia. Si considera nello specifico il fondamento della famiglia, cioè il matrimonio con i suoi riti e peculiarità. Al centro della discussione emerge la disciplina delle relazioni extra coniugali e dei reati sessuali, considerati dal legislatore e dalla Chiesa come reati di misto foro. In particolare nel Medioevo la donna onesta si presume sempre sedotta, ma nel Settecento le cose cambiano radicalmente. Un netto ribaltamento avviene con la riforma del 1981, posteriormente al caso di Franca Viola, una donna che ha rifiutato il matrimonio riparatore.

This paper has as its objective the examination of the patriarchal family from the Middle Ages to the Twentieth century. doing attention to the role of the pater familias, the value of the woman and the reputation of her family. The foundation of the family is specifically considered, that is, the marriage with its rites and peculiarities. At the centre of the discussion emerges the discipline of extramarital relations and sexual offenses, considered by the legislator and the Church as mixed-forum offenses. In particular in the Middle Ages the honest woman is presumed to be seduced, but in the Eighteenth century things changed radically. A clear change occurs with the reform of 1981, which took place after the case of Franca Viola, a woman who refused the repairing marriage.
