La crisi del sistema di Dublino e le prospettive di riforma

Abstract

Questa tesi di laurea si interroga sulla crisi del sistema di Dublino e le varie prospettive di riforma legate alla libertà di circolazione degli individui nell’Unione Europea ed alla circolazione e soggiorno dei cittadini dell’Unione Europea e dei loro familiari. Nel primo capitolo si è affrontato il tema della libertà di circolazione degli individui nell’Unione Europea e di conseguenza viene delineata in un primo momento cosa sia la cittadinanza dell’Unione Europea e i vari diritti ad essa collegati. Nel secondo capitolo si è approfondito il diritto dell’Unione europea e la relativa normativa interna la 2004/38CE la quale interessa il diritto dei cittadini dell’Unione e dei loro familiari di circolare e di soggiornare liberamente nel territorio degli Stati membri. Nel terzo capitolo si è affrontato dapprima l’argomento dell’acquis di Schengen per poi delineare il Sistema Dublino i suoi limiti e le sue riforme e la direttiva qualifiche che stabilisce norme sull’attribuzione a cittadini di paesi terzi o ad apolidi della qualifica di beneficiario di protezione internazionale che si delinea in Asilo politico.

This degree thesis questions the crisis of the Dublin system and the various reform perspectives related to the freedom of movement of individuals in the European Union and the movement and residence of citizens of the European Union and their families. The first chapter dealt with the issue of the freedom of movement of individuals in the European Union and consequently the citizenship of the European Union and the various rights related to it are first outlined. In the second chapter, the law of the European Union and the related internal legislation 2004 / 38CE, which affects the right of Union citizens and their family members to move and reside freely in the territory of the Member States, is examined in depth. The third chapter first dealt with the topic of the Schengen acquis and then outlined the Dublin System, its limits and its reforms and the Qualification Directive which establishes rules on the attribution to third-country nationals or stateless persons of the status of beneficiary. of international protection which is outlined in Political Asylum.
