I Giuristi di fronte all'epidemia

Abstract

La tesi si pone l'obiettivo di analizzare la reazione del diritto di fronte all'avvento delle epidemie, in particolare della peste a partire dal 1347 sino quasi al termine dell'epoca moderna. La tesi è così suddivisa: il primo capitolo tratta dell'organizzazione delle istituzioni e della nascita delle Magistrature della Sanità; il secondo ed il terzo trattano rispettivamente della materia penale e civile; infine nel quarto capitolo si passano in rassegna i principali giuristi che affrontarono il tema della peste nei loro trattati. Nella conclusione ho operato una comparazione tra la pandemia odierna e la peste presa in considerazione nel mio elaborato.

The thesis aims to analyze the reaction of the law in the face of the advent of epidemics, in particular of the plague starting from 1347 until almost the end of the modern era. The thesis is divided as follows: the first chapter deals with the organization of the institutions and the birth of the Health Magistracies; the second and third deal respectively with criminal and civil matters; finally in the fourth chapter we review the main jurists who dealt with the theme of the plague in their treatises. In the conclusion I made a comparison between today's pandemic and the plague considered in my paper.
