Con riferimento all’art.
The thesis examines the Biennial Preventive Agreement (concordato preventivo biennale), introduced by Legislative Decree No. 13/2024, as a tax compliance instrument based on the advance determination of the tax base through a proposal formulated by the Italian Tax Administration and accepted by the taxpayer. After reconstructing its legal nature and its relationship with the tax obligation, the study assesses its compatibility with the constitutional principles of legality in taxation and ability to pay. With regard to Article 23 of the Italian Constitution, the analysis argues that the use of secondary legislation to specify the methodology and the Synthetic Indices of Fiscal Reliability (ISA) does not, in itself, breach the principle of legality in taxation, provided that secondary legislation remains constrained by criteria established by primary legislation. The relationship with Article 53 is more complex: although the advance determination of income entails structural tensions with the requirements that the taxpayer’s ability to pay be effective and current, it does not appear inherently incompatible with that principle, provided that the methodology and corrective mechanisms ensure a reasonable connection between projected income and the taxpayer’s actual economic capacity. The thesis also examines the role of fiscal interest and consent in the reasonableness assessment. Finally, the agreement is analysed from a tax compliance perspective, distinguishing between a relational dimension and an informational dimension. Initial evidence highlights the importance of economic benefits in the decision to opt in, together with some critical issues concerning the transparency and comprehensibility of the proposal. The thesis ultimately distinguishes the constitutional compatibility of the agreement from its practical effectiveness, placing the issues identified within the broader development of automation and artificial intelligence in tax administration.en_UK
