This thesis examines the evolution of the Italian tax sanctioning system, with particular attention to the transition from the traditional dual-track criminal and administrative framework to a more complex three-track system resulting from the inclusion of tax offences among the predicate offences giving rise to corporate administrative liability under Legislative Decree No. 231/2001. The study reconstructs the historical and legislative development of criminal and administrative tax law and analyses the relationship between the different proceedings and sanctions in light of the principles of proportionality and ne bis in idem developed by national and European case law. Particular attention is paid to the consequences arising from the coexistence of the criminal liability of natural persons, administrative tax penalties and corporate liability under Legislative Decree No. 231/2001, as well as to the risk of an excessive overall punitive burden. The thesis also examines the reforms introduced by Legislative Decree No. 87/2024, focusing on the mechanisms designed to coordinate and offset the different sanctions. The analysis shows that the most recent reforms have strengthened the substantive dimension of the ne bis in idem principle by enhancing proportionality in the overall punitive response, while the procedural issues arising from the coexistence of multiple proceedings have not been fully resolved. The thesis therefore argues for moving beyond a system based on autonomous sanctioning tracks towards an integrated punitive framework, founded on preventive coordination between the competent authorities and capable of balancing the effective protection of fiscal interests with the procedural and substantive safeguards afforded to taxpayers and legal entities.en_UK
