La seguente tesi ha l'obbiettivo di riportare e analizzare le differenti e attuali posizioni della dottrina e della giurisprudenza, in merito al tema della funzione rieducativa della pena. In relazione alla tematica citata, sono approfonditi diversi aspetti, quali; -origine ed evoluzione del quadro normativo a riguardo, sia in ambito nazionale che comunitario - compatibilità dell'ergastolo ostativo e dibattito dottrinale a riguardo - il rapporto tra le misure alternative e la funzione rieducativa della pena

The following thesis aims to report and analyze the different and current positions of doctrine and jurisprudence on the issue of the re-educational function of punishment. In relation to the aforementioned topic, several aspects are explored in depth, such as; -origin and evolution of the regulatory framework in this regard, both at national and EU level - compatibility of life imprisonment without parole and doctrinal debate on the matter - the relationship between alternative measures and the re-educational function of punishment
