| it_IT |
| dc.description.abstract | This thesis examines the constitutional limits on parents' educational freedom under Italian law. Starting from the observation that Article 30 of the Italian Constitution does not expressly enshrine an "educational freedom," but rather a parental right-duty to maintain, instruct and educate one's children, the work reconstructs its content through a multi-layered inquiry: a historical-genetic analysis of the preparatory works of the Constituent Assembly; a systematic-dogmatic reconstruction of the legal nature of this right-duty and of the scope of parental convictions deserving constitutional protection; an analysis of the external limit set by the best interests of the child principle, and of the distinct internal conflict between parental educational freedom and the child's own rights as an autonomous subject; and a comparative analysis of the US, Canadian and English models. The thesis argues that parental educational freedom should not be understood as a full personal liberty, but as a function, constitutionally oriented toward the child's full development and structurally limited by the child's best interests. The conclusions show that, although unanimously affirmed at the level of legal texts, this principle meets an uneven and often selective practice, as shown by the right of the child to be heard, indefinite foster placements, the condition of unaccompanied foreign minors, statutory exemptions, and the persistence of child labour. | en_UK |
