Il presente elaborato indaga se, e in quale misura, il sistema giuridico italiano garantisca il diritto allo sport come strumento di inclusione sociale, e quale ruolo svolgano gli enti del Terzo settore nel colmare le lacune strutturali del sistema pubblico. La riforma costituzionale del 2023, che ha introdotto il comma 7 all'art. 33 Cost., ha trasformato lo sport da materia di legislazione concorrente a valore costituzionale autonomo, riconoscendone la dimensione educativa, sociale e di promozione del benessere psicofisico. Tuttavia, la proclamazione formale di tale valore non si traduce automaticamente nella sua effettiva garanzia per le categorie più vulnerabili.
L'analisi si sviluppa attraverso un metodo giuridico-comparato, articolato in tre capitoli. Il primo ricostruisce il quadro normativo internazionale e l'ordinamento sportivo italiano, fino al riconoscimento costituzionale del 2023. Il secondo confronta i modelli di governance sportiva adottati in Francia, fondato su un marcato interventismo statale, e negli Stati Uniti, basato sul pluralismo dei soggetti privati e sulla tutela individuale azionabile in giudizio. Il terzo capitolo analizza il principio di sussidiarietà orizzontale e il Codice del Terzo settore quali strumenti giuridici capaci di colmare il divario tra riconoscimento formale ed effettività del diritto, attraverso il caso di studio di FIAGOP ETS, federazione che promuove l'inclusione sportiva di bambini e adolescenti guariti da patologie oncologiche.
L'elaborato dimostra come il modello italiano, in posizione intermedia tra i due sistemi comparati, affidi agli enti del Terzo settore un ruolo complementare, e non sostitutivo, rispetto all'intervento pubblico, configurando un modello di welfare mix in cui pubblico e privato sociale concorrono alla piena realizzazione di un diritto costituzionalmente riconosciuto. This dissertation asks whether, and how far, Italian law guarantees the right to sport as a tool for social inclusion. It also asks what role Third Sector entities play in filling the gaps left by the public system. The 2023 constitutional reform added paragraph 7 to Article 33 of the Constitution. This turned sport from a matter of concurrent legislation into an independent constitutional value, recognising its educational, social, and health-related importance. However, formally recognising this value does not automatically make it real for the most vulnerable groups.
The analysis uses a comparative legal method, organised in three chapters. The first chapter looks at international rules and the Italian sports system, up to the 2023 constitutional reform. The second chapter compares the sports governance models of France, based on strong state intervention, and the United States, based on private actors and individual legal protection. The third chapter studies the principle of horizontal subsidiarity and the Third Sector Code. These are legal tools that can close the gap between formal recognition and real protection of the right. This is shown through the case study of FIAGOP ETS, a federation that promotes sport inclusion for children and teenagers who survived cancer.
The dissertation shows that the Italian model sits between the French and American systems. It gives Third Sector entities a role that supports public action, without replacing it. This creates a mixed welfare model, where public institutions and organised civil society work together to make a constitutional right real for everyone.
