Abstract

La traduzione specializzata svolge un ruolo fondamentale nell'internazionalizzazione e diffusione del sapere tecnico-scientifico, di cui ne facilita la comunicazione a tutti i livelli. La traduzione giuridico-giudiziaria, in particolare, rappresenta un elemento chiave nello studio del diritto comparato e ai fini del trasferimento dei concetti giuridici da un ordinamento all'altro. L'obbiettivo del presente lavoro è quello di esporre le fasi che conformano il processo di traduzione, così come le principali sfide che pone la traduzione di un testo giuridico. Si è scelto, a tal fine, un manuale giuridico rivolto a un pubblico esperto, che risalta per il suo livello specialistico e la coesistenza di diversi generi testuali, quali sentenze e articoli di legge. Attraverso questo lavoro, si comprenderà quanto sia importante la preparazione del traduttore specializzato: costui dovrà infatti acquisire familiarità con i testi e i tratti tipici della cultura d'arrivo, al fine di non disattendere le aspettative dei destinatari della traduzione; dovrà, inoltre, possedere competenze traduttive che gli consentano di stabilire sin da subito le priorità e i parametri su cui si basa un progetto di traduzione, ossia il contesto comunicativo e la finalità della traduzione. Tale lavoro, infine, pretenderà esaminare, in chiave contrastiva, i tratti tipici del linguaggio giuridico spagnolo e italiano, rilevando gli aspetti affini e non.

Specialized translation plays a fundamental role in the internationalization and dissemination of technical-scientific knowledge, by facilitating communication at all levels. Legal and judicial translation, in particular, is a key element for studying comparative law and transferring legal concepts from one legal system to another. The objective of this work is to present the phases that constitute the translation process, as well as the main challenges posed by translating a legal text. To this end, a legal textbook aimed at an expert audience was chosen, which stands out for its specialized level and the coexistence of various textual genres, such as court judgments and articles of law. Through this work, one will understand the importance of the specialized translator's preparation: the translator must acquire familiarity with the texts and typical features of the target culture so as not to disappoint the expectations of the translation's recipients. Furthermore, the translator must possess specific translation skills in order to immediately establish the priorities and parameters on which a translation project revolves: the communicative context and the purpose of the translation. Finally, this work will also allow for a contrastive analysis of the typical features of the Spanish and Italian legal languages, highlighting their similarities and differences.
