LE RELAZIONI DELL'UNIONE EUROPEA CON IL RESTO DEL MONDO: IL CASO DELLA CINA

Abstract

L'elaborato ha come obiettivo quello di analizzare, in una prospettiva giuridica, il ruolo dell’Unione europea come attore internazionale, ponendo particolare attenzione ai meccanismi di funzionamento delle sue competenze esterne, alla centralità della politica commerciale comune e alla risposta dell’Unione alla Belt and Road Initiative promossa dalla Repubblica Popolare Cinese. Il primo capitolo si concentra sull'attività principale dell'Unione, ossia la conclusione di accordi internazionali con Stati Terzi: mentre il secondo capitolo si sofferma sullo studio della politica commerciale comune , in particolare sul caso di Taiwan. Il terzo capitolo si concentra sul rapporto tra UE e Cina alla luce del progetto BRI. Il bilancio di questo progetto è complesso e ambivalente in entrambe le parti, oscillante tra successi parziali e criticità rilevanti. L'obiettivo è offrire una panoramica che metta in luce le opportunità e le sfide dell'Unione europea, individuandone le prospettive future di un'azione esterna fondata non solo su interessi economici ma anche sulla coerenza con i principi di diritto.

The paper aims to analyze,from a legal perspective, the role of the European Union as an international actor, with particular attention to the mechanism governing its external competences, the centrality of the common commercial policy and the Union's response to the Belt and Road Initiative promoted by the People's Republic of China. The first chapter focuses on the Union's main activity, namely the conlcusion of international agreements with Third States, while the second chapter examines the study of the common commercial policy, particularly the case of Taiwan. The third chapter concentrates on the relationship between the EU and China in light of the BRI project. The assessment of this project is complex and ambivalent on both sides, fluctuating between partial successes and significant challenges. The goal is to provide an overview that highlights the opportunities and challenges of the European Union, while also identifying the future prospects of external action based not only on economic interests, but also on coherence with the principles of law.
