Il diritto penale di fronte alle scelte sul fine vita

Abstract

Alla base di questo lavoro di tesi vi è l’analisi del fine vita. In questo lavoro sarà presente un cenno a quella che è la dignità umana per ogni individuo, profilo molto importante e parallelo alla tematica principale. L’obbiettivo di questa tesi è quello di fornire una visione completa di cosa sia il fine vita in diversi ambiti: giuridico, etico e morale, ma soprattutto su quali siano stati gli interventi della Corte costituzionale fino ad oggi, ed infine un cenno a quella che è la proposta di legge in Italia per regolamentare il suicidio medicalmente assistito. La tesi è articolata in quattro capitoli: nel primo capitolo viene analizzato, quanto e in quale modalità, il tema del fine vita sia preso in considerazione dalla nostra carta Costituzionale e dai riferimenti normativi internazionali, un breve cenno l’argomento della dignità umana e in ultimo un’analisi della legge che regola il consenso informato e le disposizioni anticipate di trattamento; nel secondo capitolo si esamina la rilevanza penale delle condotte relative al fine vita e che cosa si intende per eutanasia; nel terzo capitolo, si mira ad analizzare il caso Cappato, e come la Corte costituzionale, negli anni, si sia pronunciata in merito; in ultimo, nel quarto capitolo, si esamina la proposta di legge italiana “Liberi Subito”, le altre proposte imminenti da parte del legislatore e si tratta il primo caso di suicidio medicalmente assisto. Grazie a questo lavoro di tesi è stato possibile approfondire le più importanti sentenze in materia di fine vita e notare come negli anni, soprattutto a seguito dell’entrata in vigore della nostra Costituzione, sia cambiata la visione del bene giuridico “vita” e quindi anche del diritto, per ogni soggetto, ad autodeterminarsi e a esprimere la propria volontà in relazione alle scelte sul fine vita.

At the core of this thesis is the analysis of end-of-life issues. This work includes a reference to human dignity for every individual, a very important aspect parallel to the main topic.The objective of this thesis is to provide a comprehensive overview of what end-of-life means in different fields: legal, ethical, and moral, but especially to examine the interventions of the Constitutional Court up to today, and finally a mention of the legislative proposal in Italy to regulate medically assisted suicide. The thesis is structured in four chapters: the first chapter analyzes to what extent and in what manner the theme of end-of-life is considered by our Constitution and international legal references, a brief note on the topic of human dignity, and finally an analysis of the law regulating informed consent and advance treatment directives; the second chapter examines the criminal relevance of behaviors related to end-of-life and what is meant by euthanasia; the third chapter aims to analyze the Cappato case and how the Constitutional Court has ruled on it over the years; lastly, the fourth chapter reviews the Italian legislative proposal “Liberi Subito,” other upcoming proposals by the legislature, and discusses the first case of medically assisted suicide.Thanks to this thesis work, it was possible to deepen the understanding of the most important rulings regarding end-of-life issues and to observe how over the years, especially following the entry into force of our Constitution, the perception of the legal good “life” has changed, as well as the right of every individual to self- determination and to express their own will concerning end-of-life choices.
