Stress lavoro correlato, benessere organizzativo, responsabilità.

Abstract

Che cos’è lo ‘stress lavoro correlato’ e quanto è difficile attuare la normativa nel rispetto degli interessi sia del lavoratore sia del datore di lavoro? L’elaborato si pone l’obiettivo di rispondere al quesito. Nel primo capitolo viene descritto il fenomeno a partire dalla sua introduzione normativa in Italia, in attuazione dell’Accordo Quadro Europeo del 2004, con un passaggio dedicato alle trasformazioni del mondo del lavoro post Covid 19. Il secondo capitolo indaga gli obblighi di prevenzione e le responsabilità del datore di lavoro e approfondisce il concetto di benessere organizzativo anche alla luce dei recenti studi svolti dalle organizzazioni rappresentative di imprese e dal Ministero della Cultura. Nel terzo ed ultimo capitolo vengono esaminati alcuni casi di stress lavoro correlato su cui si è pronunciata la Suprema Corte che evidenziano le ambiguità attuative della normativa. Il metodo di ricerca seguito per la stesura della tesi è consistito in un esame della normativa, dei principali testi in materia e della giurisprudenza di legittimità e merito.

“What is work-related stress and how difficult is it to implement the legislation while balancing the interests of both the employee and the employer?” This thesis aims to answer that question. The first chapter describes the phenomenon, beginning with its legislative introduction in Italy following the implementation of the 2004 European Framework Agreement, and includes a section dedicated to the transformations in the world of work following the Covid-19 pandemic. The second chapter explores the employer’s obligations in terms of prevention and liability, and delves into the concept of organizational well-being, also in light of recent studies conducted by business representative organizations and the Ministry of Culture.

The third and final chapter examines several cases of work-related stress ruled on by the Supreme Court, which highlight the ambiguities in the practical application of the legislation. The research method used in the drafting of this thesis involved an analysis of the legislation, the main texts on the subject, and relevant case law from both the Supreme Court and lower courts.
